The 15% income tax programme, known as the Highly Qualified Persons Rules (HQP), aims to attract highly qualified persons to occupy “eligible office” with companies licensed and/or recognized by the relevant Competent Authority such as the Malta Financial Services Authority - MFSA, Malta Gaming Authority – MGA or with undertakings holding an air operators’ certificate issued by Transport Malta.
Through the enactment of Legal Notice 141 of 2018, this Programme has now been prolonged to the medical sector. Indeed the definition of the ‘competent authority’ has been extended to also include the Office of the Chief Medical Officer to Government.
It is very important to understand that the Programme does not extend itself to all jobs within the medical sector but rather to employment in the Assisted Reproductive Technology sector. The law goes on to provide the positions within the Assisted Reproductive Technology sector that would be eligible for the Programme. As a matter of fact, the eligible employments are those of Embryologist, Responsible Person and the Lead Quality Manager.
