Requirements under the employment or self-employment category

The requirements for EU/EEA Nationals to Qualify for Residency in Malta under employment or self-employment include:

Valid Identification: EU/EEA nationals must possess a valid passport or national identity card issued by their home country.

Employment Contract: The employment contract has to follow all the provisions listed down in the Maltese employment legislation.

Self-Employed individuals would also need to provide:

  • Jobsplus registration certificate issued by Jobsplus;
  • VAT registration certificate issued by VAT department;
  •  A document showing Tax registration certificate number issued by the Inland Revenue Department; 
  • A document showing National Insurance registration number. 

Requirements under the Self-Sufficiency Category

The Requirements for EU/EEA Nationals to Qualify for Residency in Malta under Self-Sufficiency include:

Valid Identification: EU/EEA nationals must possess a valid passport or national identity card issued by their home country.

Proof of Residence: Applicants must be in possession of Maltese residential address. The residential property can either be bought or rented. This can include rental agreements, utility bills, or other official documents that demonstrate their address in Malta. Financial Resources: Individuals must show that they have sufficient financial means to support themselves and any dependents during their stay in Malta. Malta's Residency Programme Options

Ordinary Residence

The Residence Programme (TRP)

The Malta Residence Programme (TRP) aims to attract Private Clients and High Net Worth families from the EU, EEA or Switzerland interested in gaining tax residence in Malta.

When the application has been approved, and the residence requirements have been satisfied, applicants will benefit from a special and favourable tax status and treatment:

  • 15% flat tax rate for all income remitted to Malta;
  • No tax for income generated outside Malta but not received in Malta;
  • No Malta tax on capital gains even if received in Malta, but realised outside;
  • Also, applicants will be entitled to double taxation relief otherwise suffered on income   arising outside Malta.

Residence in Malta can offer attractive tax rates not only to the direct applicants but also to their families: they are in fact automatically covered as long as they are direct dependents of the applicant.

Highly Qualified Persons (HQP) Scheme

The Highly Qualified Persons Scheme is aimed at attracting skilled professionals to a particular country. Even though HQP does not lead to residency, this scheme typically offers favorable conditions for EU/EEA nationals who possess high qualifications and expertise in fields such as science, technology, engineering, or mathematics (STEM). HQP schemes often provide streamlined processes, tax incentives, and other benefits to attract and retain top talent.

Student Residence Programme

EU/EEA nationals seeking to pursue higher education in another country can often benefit from Student Residence programmes. These programs allow students to reside in the host country for the duration of their studies. EU/EEA students may enjoy reduced tuition fees, access to student benefits, and the opportunity to gain valuable international academic experience.

Family Reunification Programme

Family Reunification programmes aim to facilitate the reunion of EU/EEA nationals with their family members who are non-EU/EEA citizens. These programmes typically require the EU/EEA national to meet specific criteria, such as demonstrating stable financial resources and suitable accommodation. Family members, including spouses, children, and dependent relatives, can apply for residency based on the family reunification provisions.

Malta Retirement Programme

The MRP grants Maltese residency as well as a special tax status which can be granted to retirees when remitting their pension into Malta and meeting some additional investment criteria. In fact, the applicant must be in receipt of a pension, as supported by documentary evidence, all of which is received in Malta and constitutes at least 75% of his chargeable income.

The applicant must purchase a property for at least €220,000 in Gozo or the south of Malta or €275,000 if in other parts of Malta. If the applicant wants to rent, it must cost at least €8750 per year if located in Gozo or the south of Malta or €9,600 if in other parts of Malta. In addition, an application fee of €5500 or  €6000, depending on the property's location, must be paid. 

The cost of applying for the MRP is between €14,750 and €281,000, depending on the property route chosen.

The Nomad Residency Permit

A Nomad Residence Permit is issued for one year, renewable, for as long as;

  • You work for an employer registered abroad;
  • Your foreign employment allows you to work remotely in Malta;
  • You are paying taxes in a foreign jurisdiction and will continue to pay taxes in such jurisdiction even once you have the nomad visa (no tax will be payable in Malta);
  • Have a steady monthly gross income of at least €2,700, and at least twenty (20%) per cent of the median wage for each family member.

Under this permit, you will be able to work remotely with no tax consequences in Malta.

The vetting process of the application takes around 30 working days. Once the application is approved, an appointment is set for you to take your biometrics. The residence card takes between two (2) to three (3) weeks to be issued. Once issued, you will need to pick up the card in person.

Process and Documentation

Step 1 - The first step involves the onboarding process. At this stage, basic identification documents are needed. Such documents include a Passport, Utility Bill as Proof of Address, the CSB Application Form, and CV or Linkedin Profile.

Step 2 – Gathering all necessary forms and supporting documentation. CSB Group will be able to support you with this process.

Step 3 - Have the biometric data taken and be issued with a Maltese residency card whose validity depends on the type of residency route taken.
